Service Description

Pentaudis, Consultoria para o Negócio e a Gestão UP, Lda., with VAT number 504 222 066, headquartered at Rua Cidade de Liverpool 16, 4º Esq, 1170-097 Lisbon, provides services that consist of conducting market and opinion studies, many of them through the use of a consumer panel (PINTA D’AMARELO). Pentaudis communicates with the members of its panel through the channels it provides and those the panel member has provided at the time of registration.

Registration and Personal Data

Registration in the panel is usually open to people who meet the eligibility requirements, including a minimum age requirement and a geographic location requirement. These requirements may vary in accordance with the needs of the Pinta d’amarelo client projects. Only one registration per person is allowed, and if we verify that the same person has used two or more emails to register for the panel, all accounts related to that same member will be removed from the panel. At the time of registration, the user must choose a password, and the security and use of this password, as well as their username, is entirely the responsibility of the individual, and consequently the use of their account on the PINTA D’AMARELO portal. Participation in the panel is specific to the individual who registers for the panel. The data collected through the registration survey, as well as those intended to socio-demographically characterize each element of the panel, aim to select panel members to carry out market and opinion studies by Pinta d’amarelo, committing itself to not assign any other purpose to the personal data collected. The legal basis for processing personal data collected is based on the consent that each panel member must give, for the above-mentioned purpose. It should be noted that the provision of this data is mandatory and the veracity of the data is the user’s responsibility. The updating of each member’s data is carried out regularly, although each member may personally update their data whenever necessary. By accepting these terms and conditions, the user expressly consents that their personal data be processed in accordance with the General Data Protection Regulation and for the purposes described above. Registration can be canceled at any time, with the member having the total right to be forgotten, a right enshrined in the General Data Protection Regulation.

Applicability

These terms and conditions apply to the use of Pentaudis, Lda. services, including joining a Pentaudis panel or subpanel, notably the PINTA D’AMARELO panel; its use and/or access to the panel website, as well as participation in any and all studies hosted, administered, and made available by Pinta d’amarelo; their eligibility; redemption of rewards, incentives, and prizes or donations, opportunities offered for certain actions and activities, including the successful completion of studies. By registering, using and/or participating in studies developed by Pinta d’amarelo, you expressly agree to comply with the terms and conditions now presented. Pentaudis reserves the right to refuse, restrict, or prohibit your access, use, and participation in the studies, at any time and for any reason.

Use and Content

By accepting these terms and conditions, the user agrees not to: carry out any actions with the intent to manipulate results, download and store any data and content, use any “data mining” techniques, misuse the portal for purposes not expressed in this document, send or transmit any types of codes and/or information that may cause damage to the platform and its users, use the links, logos, and brands used in the portal, publish or transmit any type of material or content that may violate the laws applicable to this type of platform, forge identity, use any content of the portal, encourage or advise any person to commit any act that may harm Pinta d’amarelo and/or any persons related to it. By using the PINTA D’AMARELO portal, you will have the opportunity to read and/or access information, documents, products, and restricted content belonging to Pentaudis, Lda. and/or its clients and partners. This content is the exclusive property of its owner and under no circumstances will this right be transferred to you. By registering on our portal, you agree to protect the confidentiality of this content and, consequently, not to make: copies, alterations, displays, and distribution, transmission, transfers; or perform any other actions without the explicit and prior consent of Pentaudis, Lda. The user of the PINTA D’AMARELO portal agrees that the contents visible on the platform may be protected by intellectual property laws, regulations, and codes. By breaking any of the restrictions and prohibitions provided herein, Pentaudis, Lda. will have the right, according to the law, to take legal action.

Participation

Participation in MORE Results projects depends directly on the profile of the users. The number of invitations is intended to be balanced among the various panel members, with no limit on the participation of each member. However, the characteristics of the projects define what the necessary sample is, as well as its characteristics. It is therefore important that, whenever necessary, you update your data. Panel members, by registering for it, commit to providing truthful information, so if answers are detected that may suggest inconsistency in the information provided, participation in the respective project is not validated and the account will be eliminated/suspended.

Rewards

For registration, participation, and recommendation on the Pinta d’amarelo portal, points are awarded to panel members. These points are accumulated and can later be exchanged for a set of rewards that we have available on our portal. The points are valued in euros, with each point corresponding to an amount of €0.05. The exchange of points for one of the rewards can be made from 100 points – €5. The value of participation varies according to each project, particularly in terms of its typology, needs, and time to be spent on it. The only fixed values are the registration in the panel and the referrals of new members, whose points are 5 (to which another 15 will be added after filling out the profiling questionnaire), 10 respectively. It should be considered that points are only credited to the user’s account when their information and answers are validated, regardless of whether it concerns registrations, referrals, or participation in studies.

Account Cancellation

Your account can be canceled if you wish, on the PINTA D’AMARELO portal itself. Cancellation of the account implies that the member will no longer receive any information or communications from PINTA D’AMARELO and that all their information in the panel will be deleted (personal information, activity record, and points).

Communications

All communications and information transmitted to Pinta d’amarelo, except for personal data, are considered non-confidential information and consequently treated as such, thus not having a priority nature.

Changes

Pinta d’amarelo reserves the right to make changes to these terms, so we encourage all users to review these terms periodically. If the revisions made or to be made require any kind of authorization from the users of the PINTA D’AMARELO portal, Pinta d’amarelo will obtain the due consent from them. All others that do not require consent will constitute the user’s acceptance based on the present terms.

Exemption and Limitation of Liabilities

The user, based on these terms, agrees to exempt Pentaudis. Lda, and, consequently, its brands, members, collaborators, governing bodies, and agents, from and against any and all claims, liabilities, losses, judgments, fines, penalties, and costs and/or expenses of any kind, including, among others, attorney’s fees and court costs, arising from or caused, directly or indirectly, by a violation of these terms and conditions and/or full use of the PINTA D’AMARELO portal. Except for what is legally provided and applicable, the user acknowledges and agrees that Pentaudis, Lda. will have no liability for practices carried out by the user, regardless of whether the consequences of these have a punitive result and even if they have been communicated by the user themselves.

Compliance with Law

The user acknowledges and agrees that they will comply with all national and international laws, codes and regulations, standards, in short, all applicable legislation regarding the use, participation, and access to the services present on the PINTA D’AMARELO portal.

Other Terms

The points/titles contained in, and especially the intrinsic non-exhaustively present in the referred terms and conditions, cannot be considered for the purpose of interpretation and or use of these terms, so any infraction or damage caused by the user is their entire responsibility.
